Falsely Legal

The judicial procedure includes the police investigation into a possible criminal offence (it is not necessary that judicial proceedings have been initiated). A false statement that could lead to the wrongful arrest or conviction of an innocent person is sufficient. The word perverse may mean « change, » but the behavior doesn`t have to go that far – any action that disrupts an investigation or causes it to go in the wrong direction can tend to pervert the course of justice. The prosecution need only prove that there is a possibility that what the plaintiff did « without more » could lead to unlawful consequences, such as the arrest of an innocent person (Murray (1982) 75 Cr. App. R. 58). This ensures a consistent approach. Prosecutors reviewing these cases must have read the Senior Legal Counsel`s report « In the Spotlight » and be familiar with all relevant legal policies and guidelines.

Prosecutors must ensure that they have sufficient information about the suspect`s vulnerability to ensure that decisions made under the Crown Attorneys` Code are properly informed. This may include proactive measures to obtain medical or other evidence on the subject. In this regard, prosecutors should be aware of the legal guidelines for offenders with mental disorders for reasons of distraction and public welfare. The extent and circumstances of any discrepancies must be carefully considered. A positive contradiction in the suspect`s assertion is much more valuable than inconsistencies. According to the law, a false retraction of a truthful report could form the basis for prosecution of a relevant crime.
